These Terms of Service (“Terms”) are a binding agreement between you and [Your registered business name or full name] (“NatCamp”, “we”, “us”, “our”), operator of the NatCamp website and application (together, the “Platform”). By accessing or using the Platform, creating an account, listing a property, or making or accepting a booking, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
1. Definitions
- Host — a user who lists and offers a campsite, homestay or other accommodation.
- Guest — a user who books or seeks to book a stay.
- Listing — a property and its details published on the Platform.
- Booking — a reservation of a Listing for specified dates.
- Content — any text, photos, reviews, messages or other material submitted by users.
2. Our role — marketplace intermediary only
NatCamp provides an online platform that connects Guests with Hosts. We are an intermediary only. The accommodation and any related services are provided solely by the Host, and any contract for a stay is formed directly between the Guest and the Host. NatCamp is not a party to that contract, is not the owner, operator, organiser or agent of any Listing, does not own, control, manage, inspect or supervise any property, and provides no accommodation itself. Any curation, “verified” status or featuring of Listings is a discretionary editorial signal and is not a warranty, certification, endorsement or guarantee of any Host, property, safety, legality or quality.
The Platform also hosts user-generated content and social features — profiles, a community feed, groups and direct messages. As to these, NatCamp acts only as a neutral host, conduit and intermediary for content and communications created by users. We do not author, pre-screen, endorse or verify user content, and we are not responsible for it. Views expressed by users are their own. Any group is created and run by the user who owns or administers it — that person, not NatCamp, is responsible for the group and what happens in it.
3. Eligibility & accounts
- You must be at least 18 years old and legally able to enter into contracts.
- You must provide accurate, current and complete information and keep it updated.
- You are responsible for safeguarding your credentials and for all activity under your account.
- We may refuse, suspend, restrict or terminate any account at our discretion, with or without cause and without liability (see Section 13).
4. Host obligations & warranties
If you list a property, you represent, warrant and agree that:
- You have the right and all authorisations to offer it, and your Listing is accurate and not misleading.
- You hold and will maintain all licences, permits, registrations (including any required homestay/ tourism registration), and adequate insurance, and you comply with all applicable laws, safety, fire, health and zoning requirements.
- You are solely responsible for the property, its condition and safety, for guests' experience and for resolving disputes relating to the stay.
- You are solely responsible for your own taxes (including any applicable income tax and Sales & Service Tax) and for any required reporting.
- You will honour confirmed bookings and your stated prices, availability and house rules.
- You indemnify NatCamp (Section 12) for claims arising from your Listing, your property or your conduct.
5. Guest obligations
- You will provide accurate booking details, use the property lawfully and responsibly, respect the Host's house rules, and leave the property in good condition.
- You are responsible for the conduct of anyone in your party and for any loss or damage you cause.
- You are responsible for assessing whether a stay is suitable for you and your party.
6. Bookings, prices, payments & fees
- Prices are shown in Malaysian Ringgit (MYR) and set by the Host. Payment is made either online via a third-party processor (e.g. Stripe) or directly to the Host (e.g. bank transfer/DuitNow), as indicated.
- Where NatCamp charges a service fee or commission, it will be disclosed before you confirm and, to the maximum extent permitted by law, is non-refundable.
- Payment processing is provided by third parties under their own terms; NatCamp is not liable for their acts, omissions, fees, delays or failures.
- You are responsible for any chargeback, reversal or unpaid amount and for any costs we incur as a result of it.
7. Cancellations, refunds & no-shows
Cancellation, refund and no-show terms are set by the Host and/or shown at booking. Any refund of accommodation charges is a matter between Guest and Host; NatCamp is not responsible for issuing refunds of amounts it does not hold and, to the maximum extent permitted by law, is not liable for a Host's or Guest's cancellation, refusal, no-show or failure to perform.
8. Assumption of risk & release (outdoor & camping activities)
Camping, the outdoors and travel involve inherent and significant risks, including but not limited to: uneven or remote terrain, weather and natural events, fire and cooking hazards, water and drowning risks, wildlife, insects, plants and allergens, limited mobile coverage, and limited or delayed access to medical or emergency services. To the maximum extent permitted by law, you voluntarily assume all such risks for yourself and your party, acknowledge that you participate at your own risk, and release and discharge NatCamp and its owners, officers and personnel from any and all claims, demands, liabilities, injuries (including personal injury or death), loss or damage arising out of or relating to a stay, a property, or activities undertaken before, during or after a booking. This Section does not exclude any liability that cannot lawfully be excluded.
9. User content, community, groups & messaging
- You may submit Content (reviews, diary posts, photos, comments, group posts, profile details and messages). You must own or have the right to share it; it must be lawful, genuine, accurate and not infringing, defamatory or abusive. You are solely responsible for your Content and for your interactions with other users.
- Groups. Any group is created and controlled by its owner/administrator, who is a user acting on their own behalf — not NatCamp. Group owners/admins are responsible for their group, its membership decisions and the content shared in it, and must run it lawfully and in line with our Community Guidelines. We may remove, rename, restrict or delete any group, and remove any member, at our discretion.
- Direct & group messages. Messages are private communications between the users involved. We do not routinely monitor them, are not responsible for their content, and are not a party to your conversations. We may, however, access, preserve and disclose message content where we reasonably believe it is necessary to operate the service, enforce these Terms, ensure safety, or comply with the law or a lawful request from authorities. Do not use messaging to send unlawful, abusive or unsolicited (spam) content, or to circumvent the Platform or its fees.
- You grant NatCamp a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to host, store, reproduce, adapt, publish and display your Content to operate, promote and improve the Platform. This licence survives termination for Content others have interacted with or that we retain in backups or as required by law.
- You grant us a perpetual, irrevocable, royalty-free licence to use any feedback or suggestions you provide, without obligation to you.
- Moderation & reporting. We may, but are not obliged to, monitor, moderate, edit, restrict or remove any Content, group or account at our discretion. Users can report content or conduct via the in-app report tools; we review reports and act where appropriate. We have the right (but not a general duty) to monitor Content, and acting on some Content does not oblige us to act on all.
10. Acceptable use & prohibited content
You must not post, share, send or otherwise make available any Content, or engage in any conduct, that:
- is unlawful, fraudulent, infringing, misleading, or that facilitates any illegal activity (including unlicensed gambling, sale of prohibited goods, or money laundering);
- is obscene, pornographic or indecent, or that in any way involves child sexual abuse material or the exploitation of minors — which we treat with zero tolerance, will remove, and will report to the police and relevant authorities;
- is offensive, indecent, false, menacing or intended to annoy, abuse, threaten or harassanother person, or that amounts to harassment, stalking, bullying, threats or intimidation — including content prohibited by Malaysia's Communications and Multimedia Act 1998 (section 233);
- is likely to incite hatred, hostility or unrest, or that offends the sensitivities commonly referred to in Malaysia as the “3R” — race, religion and royalty — or that is seditious or promotes enmity between groups (having regard to the Sedition Act 1948and the Penal Code);
- is defamatory, or that discloses another person's private or personal data without their consent (“doxxing”), or that infringes privacy or intellectual-property rights;
- is hateful or discriminatory, or that promotes violence, self-harm, terrorism or extremism;
- is spam, unsolicited solicitation or advertising, a scam, or a fake, incentivised or manipulated review;
- impersonates any person or entity, or misrepresents your affiliation with anyone;
- circumvents the Platform, its bookings or fees, or that scrapes, reverse-engineers, uses automated access against, probes the security of, or otherwise interferes with the Platform or other users.
We cooperate with the Malaysian Communications and Multimedia Commission (MCMC), the police (PDRM) and other lawful authorities, and may remove Content, suspend accounts and disclose information as permitted or required by law.
11. Disclaimers — “as is”
To the maximum extent permitted by law, the Platform and all content are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy or non-infringement. We do not warrant that the Platform will be uninterrupted, secure or error-free, that Listings are accurate, available, lawful or safe, or that any Host or Guest will perform as expected. We do not screen, vet or guarantee any user beyond any limited curation we choose to perform.
12. Limitation of liability & indemnity
To the maximum extent permitted by law: NatCamp (and its owners, officers and personnel) shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, bookings, or for personal injury, death, or property loss/damage, arising out of or relating to the Platform, any stay, any Listing, or the acts or omissions of any Host, Guest or third party — whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised of the possibility of such damages.
Our total aggregate liability for all claims relating to the Platform or a transaction shall not exceed the greater of (a) the total service fees actually received by NatCamp from you for the transaction giving rise to the claim in the three (3) months before the event, or (b) MYR 100.
You agree to defend, indemnify and hold harmless NatCamp and its owners, officers and personnel from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to: your use of the Platform; your Content; your Listing, property or stay; your breach of these Terms or any law; or your infringement of any third-party right.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including under the Malaysian Consumer Protection Act 1999; where liability cannot be excluded, it is limited to the minimum permitted by law.
13. Suspension & termination
We may suspend, restrict, remove Listings or Content, or terminate your access, at any time, with or without notice or cause, including where we suspect a breach, risk, fraud or harm — without liability to you. You may stop using the Platform or close your account at any time. Sections that by their nature should survive (including 4–12, 14–16) survive termination.
14. Third-party services & links
The Platform integrates or links to third-party services (e.g. payment processors, messaging providers, maps, image hosting). We do not control and are not responsible for third-party services, their content, terms or availability. Your use of them is at your own risk and subject to their terms.
15. Force majeure
NatCamp is not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic or pandemic, war, civil unrest, strikes, government action, utility, network, hosting or third-party failures, or acts of God.
16. Governing law & dispute resolution
These Terms are governed by the laws of Malaysia. You agree first to attempt to resolve any dispute with us informally by contacting us. If unresolved, the courts of Malaysia shall have exclusive jurisdiction, and you submit to that jurisdiction — without prejudice to any mandatory rights you have in your place of residence. To the extent permitted by law, you agree to bring claims only in an individual capacity and not as part of a class or representative action.
17. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified via the Platform, and the “effective date” above will be updated. Your continued use after changes take effect constitutes acceptance.
18. General
- Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Platform and supersede prior agreements.
- Severability: if any provision is held unenforceable, the rest remains in effect and the provision is modified to the minimum extent necessary.
- No waiver: our failure to enforce a provision is not a waiver of it.
- Assignment: you may not assign these Terms; we may assign them, including in connection with a merger, acquisition or sale of assets.
- Independent parties: no partnership, agency, employment or joint venture is created.
- Electronic communications: you consent to receive communications and notices electronically.
- Language: the English version prevails in case of any conflict with a translation.
